Process for Being Appointed Personal RepresentativeIn Florida, before someone is officially appointed to serve as the personal representative of an estate, the person must file a petition with the Florida probate court. This is the case even where a testator names a person as personal representative or executor in his (or her) will. The person must still filed a petition requesting the appointment. The court will then review the petition and determine if the petitioner is qualified to serve. If the court approves the petition, the court will issue an order that appoints him (or her) as the personal representative and granting him letters of administration.
